Training Visa (Subclass 407)

 

Training Visa (Subclass 407) is for people who want to temporarily come to Australia to participate in occupational training or professional development for up to two years.

Eligibility

In order to qualify for 407 Visa, you must meet the following requirements:

  • Sponsored (by an approved sponsor of a relevant class) to participate in workplace-based occupational training activities or classroom-based professional development activities
  • Identified in an approved nomination by an Australian organisation (other than a Commonwealth agency)
  • Invited (if the sponsor is a Commonwealth agency)
  • Meet the requirements for the visa
  • Have functional English language skills
  • Have a genuine intention to stay temporarily in Australia
  • Have adequate financial support for yourself and accompanying family members while in Australia
  • Have adequate arrangements for health insurance while in Australia
  • Meet health and character requirements
  • At least 18 years of age (except in limited circumstances).

Sponsorship

To be a sponsor, the organisation must be one of the following:

  • an organisation lawfully operating in Australia;
  • Government agency; or
  • Foreign government agency.

In addition, there must be no adverse information known about the sponsor or a person associated with the sponsor, unless it is reasonable for the Department to disregard the information. Further, the organisation has the capacity to comply with the sponsorship obligations and directly provide the occupational training, unless an exemption exists.

Nomination

An organisation can nominate someone for Training Visa if:

  • An approved temporary activities sponsor; or
  • Have already lodged an application to be an approved temporary activities sponsor.

A nomination application will not be approved unless sponsorship is approved.

Applicants may qualify for this visa under the following category depending on their circumstances:

  • Workplace-based training required for registration
    This is for people who are required to undertake workplace-based training (not to include professional development) to obtain registration, membership or licensing in Australia, or their home country, in order to work in their occupation. Training must be for at least 30 hours per week wherein no more than 30% can be classroom-based.
  • Structured workplace-based training to enhance skills in an eligible occupation
    This is for people with relevant experience in the nominated seeking to undertake a structured workplace-based training program.
  • Training that promotes capacity building overseas

1. Overseas qualification. enables students currently enrolled in a foreign educational institution to complete for up to six months period a structured workplace-based training in Australia.
2. Government support. Undergo a structured workplace-based occupational training which by obtaining support from a government agency either in Australia or the government in the home country.
3. Professional development. This is for senior level or professional employees sent Australia to commence professional development program of face-to-face teaching in a classroom or similar environment.

Remuneration

Occupational trainees in subclass 407 must be paid in accordance with the existing Australian industrial relation laws unless undertaking volunteer work.

A copy of the training contract or agreement with the details of the remuneration must be included with the nomination.
