TSS Visa (Subclass 482)

Temporary Skill Shortage Visa 

TSS Visa (Subclass 482) category has replaced the 457 working visa and is for qualified workers from overseas to fill in existing genuine short-term and medium-term skill shortages in the workforce of an Australian sponsor. There are two streams under 482 Visa: 

  • Short-Term Stream – can be renewed once while onshore; and
  • Medium-Term Stream – eligible to apply for permanent residency after three years.

Sponsorship

To become a sponsor, the business must:

  • Be actively and lawfully operating in Australia;
  • Have no adverse information; and
  • Pay contribution to the Skilling Australians Fund (SAF).

SAF should be paid in full at the time of the nomination. The contribution of $1,200 for small business with an annual turnover of less than $10 million, and $1,800 for other businesses. Funds paid to SAF will be refunded if the nomination fee is refunded due to nomination withdrawal if the occupation has been removed from the occupations list.

Nomination

Under the TSS Visa, the following criteria must be met:

  • occupation must be on the eligible occupation list. STSOL for Short-Term stream and MLTSSL for Medium-Term stream;
  • meet the requirement for the minimum salary as per Temporary Skilled Migration Income Threshold (TSMIT) as well as the market salary rate for the nominated occupation; 
  • meet the mandatory labour market testing; and
  • meet the non-discriminatory workforce test.

The sponsoring business must demonstrate that it has exhausted all efforts to fill in the skill shortage. Likewise, non-discriminatory workforce test must be imposed to ensure that employers are not actively discriminating against Australian workers.

Visa Application

To be eligible, the worker must:

  • meet the minimum English language requirement;
  • meet the two years’ work experience;
  • meet the mandatory criminal check; and
  • meet health requirement.

Currently, the English requirement for the Short-Term stream is set to a score of 5.0 in IELTS or equivalent with a minimum score of 4.5 in each component. However, in the Medium-Term stream, the English requirement is set to 5.0 in each component.

The visa holder will be eligible to apply for a permanent visa after having worked for three years on 482 visa.
