Employer Eligibility
To successfully nominate a position under ENS Visa, the employer must satisfy the following criteria:- Actively and lawfully operating a business in Australia.
- Genuinely need a paid employee for that position.
- No adverse information is known to DIBP about the business or a person related to the business
- Meet the requisite training benchmark and possess a strong record with respect to training Australian employees.
- The position must be full-time and ongoing for two years.
- Pay the Market Rate Salary with the same conditions and terms of employment as for an Australian performing the same type of work in the same area.
Employee Eligibility
There are three possible pathways for which the employee may qualify for an Employer Nomination Scheme Visa, including:- Temporary Transition Stream (TRTS). The applicant has worked for the nominating employer for at least 3 years as a holder of a TSS visa before submitting the nomination application. The nominated position must be the same and is permanent. Under this stream, the applicant must not have turned 45 years of age and have at least competent English (IELTS 6 or equivalent unless an exemption applies). Skills assessment is not required.
- Direct Entry Stream (DE). English level of IELTS 6 or equivalent is necessary, the applicant must have passed skills assessment, the applicant must show a work history of at least 3 years in the nominated occupation, and the applicant must not have turned 45 years of age
- Agreement Stream. The nominating employer has a Labour Agreement or a Regional Migration Agreement.The applicant must satisfy the age, English, and experience/skills requirement as stated in the agreement
