Labour Market Testing Update – September 2020 

 

The Department of Home Affairs announced a new legislative instrument (LIN 20156) which aims to prioritize Australian citizens and PRs before overseas candidates are considered when a business announces a vacancy.

The additional requirements for new labour market testing includes:

  • Must be advertisements on at least 2 job platforms like Seek, Indeed, LinkedIn

  • The job must also be advertised on the Government’s jobactive website, which is free

  • Job advertisement should be ‘live’ for 28 days.

  • Advertisement should show the salary range and the business name (or recruitment agency)

  • Job ad must have been undertaken in the four months immediately prior to lodging the relevant nomination application.

  • Each advertisement of the nominated position must be commissioned or authorised by the approved sponsor.

New requirements will take effect from 1 Oct.

Labour Market Testing is a requirement for all businesses nominating an overseas skilled worker on a Subclass 457 Temporary Work, Subclass 482 Temporary Skill Shortage, or Subclass 494 Skilled Employer Sponsored Regional (Provisional) visas.
