ENS Under Highly Paid Position

Effective 5th December, 2010, DIAC have increased the "highly paid" salary option under ENS to be approved on the basis of a highly paid position. 

One of the options for a client to meet the skill requirement for an Employer Nomination Scheme (ENS) Subclasses 121 and 856 visa is to be paid a salary in the nominated occupation that is at least the amount of the salary specified in a Gazette Notice". The current Gazette Notice specifies the "highly paid position" salary is now AUD$250,000. Previously, it was AUD$165,000.  

 

To be eligible for Onshore ENS Visa (Subclass 856) you must meet one of the following requirements:

  • have worked full-time in Australia in the nominated occupation on a Visa Subclass 418, 421, 422, 428, 444, 457 or 461 temporary residence visa for the last two years prior to the visa application being made (including at least the last 12 months with the nominating employer)
  • have been nominated to fill a position with a base salary of more than $250,000 per annum (excluding superannuation or allowances)
  • have had your skills assessed as suitable by the relevant skills assessing authority and, unless exceptional circumstances apply, have at least three years full-time work experience in the occupation before the visa application is lodged. A list of assessing bodies can be found in the Employer Nomination Scheme Occupation List (ENSOL)
