About these Visas

If you are in a relationship with an Australian citizen, Australian permanent resident or an eligible New Zealand citizen, you may be able to apply for a partner visa. The three main partner visa subclasses are Spouse, Fiancé and Interdependent partner.

Partner Visa (Spouse VISA) Subclasses

Partner - Inside Australia - Subclass 820 (Temporary) & Subclass 801 (Permanent) & Partner - Outside Australia - Subclass 309 (Temporary) & Subclass 100 (Permanent)

This visa allows you to enter and remain in Australia on the basis of your relationship (married or de-facto) with your sponsoring partner. Subclass 820 is a temporary visa usually for two years, granted until a decision on the permanent visa has been made. To be eligible, you must be married to your partner or be in a de-facto relationship for more than one year. You and your partner must show that the relationship is genuine and continuing and that there is a mutual commitment to a shared life to the exclusion of all others. If after your two year waiting period the relationship is proven to be continuing, you can be granted the permanent Subclass 801. Note: Some relationships are eligible for the permanent visa without the waiting period, by applying for a waiver (e.g. if relationship is over five years, or over two years with dependent children).

Interdependent Partner - Inside Australia - Subclass 826 (Temporary) & Subclass 814 (Permanent) & Interdependent Partner - Outside Australia - Subclass 310 (Temporary) & Subclass 110 (Permanent)*

This visa generally has the same criteria as the spouse visa, except it is for partners in same sex relationships. You and your partner must show that the relationship is genuine and continuing and that there is a mutual commitment to a shared life to the exclusion of all others.

Prospective Marriage/Fiancé - Subclass 300

This visa subclass is for people overseas who wish to enter Australia to enable them to marry their partner. You may then apply for a spouse visa, Subclass 820, if still in Australia.
